ISSA Appeals Process

IDAHO STATE SOCCER ASSOCIATION APPEALS PROCESS

310 APPEALS

                       SECTION  1. The ISSA shall entertain appeals from the decisions of leagues.

                       SECTION  2. The appeals committee has the power to call for the production, by the

                                                  appellant and appellee, of any documents and evidence the committee may

                                                  require.

                       SECTION  3. An appeal must be made in writing and must be sent by mail to the office of

                                                 the secretary within (10) ten days from the date of the official receipt of the

                                                decision by the party seeking the appeal.

An appeal shall not be considered valid unless it further complies with the following:

a        Not less than (6) copies of the complete appeal shall be sent.

b        Not less than (6) copies of the bylaws, rules, policies, applications and any other pertinent directives of the organization against whose decision the appeal is taken shall accompany the appeal.

c        The fee of $200.00 shall accompany the appeal and be in the form of cash, money order, or cashiers check.

d        A copy of the appeal will be sent to the league whose decision you are appealing and a signed statement showing the date, when and address to which the appeal was sent will accompany the appeal to the ISSA.

e        The applicable appeal fee is non-refundable and shall be retained by the ISSA. 

f        The league has (10) ten days from the date a copy of the appeal was received to submit to the ISSA six (6) copies of all material the appellee considers reverent to the appeal.  The chairperson of the appeals committee at their discretion will also require notice of the appeal to particular parties who may be affected by the appeal and may allow those parties to submit six (6) copies of any materials this party considers relevant to the appeal, within a time specified by the chairperson.

g        A decision rendered by an affiliated league or other organization from which an appeal is taken is not suspended pending the final hearing of the appeals committee unless the committee so orders.  The decision of an affiliated league or their organization may be reversed or changed, and the penalty may be increased to comply with the rules of this Association or the Federation.  The committee shall also determine who shall bear all expenses incurred in connection with the appeal other than the applicable appeal fee.

h        In the absence of an appeals committee the President will serve as the committee and may appoint others to assist in rendering judgment.

                       SECTION  4. The appeals committee will notify the party submitting an appeal that was sustained the further appeal process at the time the decision is rendered.
